Steel Safeguards Update

It has been just over one year since the first announcement of the steel and aluminum tariffs imposed by the United States and Canada has been implementing its own safeguards for better or for worse.

DS557: Canada — Additional Duties on Certain Products from the United States

Not about to be outdone by the Canadian countermeasures and surtaxes on steel, the United States has begun its own dispute against Canada at the WTO.

DS550: United States — Certain Measures on Steel and Aluminium Products

Canada is joined at the WTO by Japan, China, Thailand, the EU, Russia, India, Mexico and Norway in its dispute with the USA’s steel and aluminum tariffs.

Anti-Dumping Alert: Nitisinone Capsules (Sweden)

On September 21, 2018, the CBSA initiated an investigation respecting the alleged injurious dumping of nitisinone capsules from Sweden.  The investigation follows a complaint filed by Laboratoirs KABS Inc. and MendeliKABS Inc.

Canada has announced provisional safeguard measures of 25% on 7 steel products: heavy plate, concrete reinforcing bar, energy tubular products, hot-rolled sheet, pre-painted steel, stainless steel wire, and wire rod commencing on October 25, 2018.

Safeguard action related to imports of certain steel products

On August 14, 2018, the Department of Finance announced the steps for the steps to prevent diversion of steel products into Canada, which will be begin with public consultations on the matter.  There is currently an invitation to submit views on the matter. Will public input matter?

Expiry Review of Seamless Carbon or Alloy Steel Oil and Gas Well Casing

The CITT is conducting an expiry review of seamless carbon or alloy steel oil and gas well casing. The CBSA has determined that expiry of the previous order is likely to result in continued dumping and/or subsidizing of the goods.

CITT – Expiry Review of Carbon Steel Welded Pipe

The CITT has given notice that it will pursuant to section 76.03(3) of the Special Import Measures Act initiate an expiry review of its order made August 19, 2013, concerning the dumping and subsidizing of carbon steel welded pipe. The CBSA is conducting its own investigation into whether dumping is likely to continue should the order expire.
